When U.S. District Judge Lyle Strom overthrew a jury verdict against IBP in the Pickett versus Tyson cattleman's class action lawsuit, I wasn't shocked or surprised. I didn’t think the system worked and the Judge only confirmed my suspicion. My initial response was that if a judge can overrule a jury, why bother with the jury process? Why should plaintiffs even bother to argue a case to a jury when a judge has veto power over the procedure? It seems like a whole lot of trouble and expense to go through to pick a jury, disturb their lives, have Tyson lawyers and economists insult them as not being smart enough to decide a case this complicated, and then have the judge pitch their finding. If I was one of the jurors, I think I'd find Judge Strom in contempt of court. It's hard not to have contempt for such a system.

America’s Cattlemen’s Trial

It was Monday, February 9, 2004 – the evening before closing argument.  The jury would get the case tomorrow.  I was in my hotel room worrying about the result.  We had put on a strong case with four weeks of evidence showing that Tyson had used captive supplies to push cattle prices lower.  But would the jury see it that way?  Would they find that we missed something?

Alabama Jury Rules for Cattle Producers in Landmark Competition Case

(Billings, MT)  R-CALF United Stockgrowers of America (R-CALF USA) heralded the jury verdict in the landmark Pickett vs. IBP class action cattle competition lawsuit.  Today the jury awarded $1.28 billion to the cattlemen suing Tyson/IBP for using captive supplies to negatively manipulate live cattle prices.

For the last few years I’ve had these nagging feelings of OPTIMISM regarding the possibility that cattlemen would NOT become a herd of contract cowboys working as serfs on their own land for the benefit of the big three packers. Admittedly, there was a brief bout of depression following the merger of our checkoff dollars with the NCBA, but then it dawned on me: That merger and the increasing arrogance of NCBA afterwards was what made cowboys mad enough to change the direction our industry was headed. Without it we may never have had R-CALF or Pickett versus IBP.

Economist made the winning case against Tyson

 

Lawyers tend to get the glory in any historic court case, which the Pickett case could be if it survives appeals. But in the verdict reached against Tyson Fresh Meats in Montgomery, Alabama today, it may have been an economist who made all the difference.
